State guide: California
California (BPELSG) Engineering Guide: Seismic and Surveying Exams, DSA and HCAI SE Rules, PE Stamp Costs and the CA R&D Credit
California is the most expensive state in our benchmark set to get structural work sealed: the house multiplier is 1.35x, so a $3,800 base structural seal becomes $5,130 and a $2.4M structural package lands near $38,880 before travel. Out-of-state civil engineers cannot use plain comity here; they must pass two California-specific exams first, which is why lead time, not fee, is usually the real constraint.
01The board, the statute and what each licence allows
Engineering in California is regulated by the Board for Professional Engineers, Land Surveyors, and Geologists (BPELSG) under the Professional Engineers Act, Business and Professions Code section 6700 et seq. The Act splits disciplines into two kinds. A practice act discipline means only a licensee may do the work. A title act discipline means only a licensee may use the title, but unlicensed people may still do some of the work under exemptions.
Civil, electrical and mechanical engineering are the practice acts that matter most to buyers. Structural engineering is a title authority layered on top of a civil licence: a civil PE who passes the NCEES 16-hour SE exam may call themselves a structural engineer, and certain public building types require that authority.
The detail that catches out-of-state firms is the civil exam path. A civil applicant must pass the NCEES PE Civil exam plus two California-specific tests: Seismic Principles and Engineering Surveying. An engineer licensed for years in Arizona or Texas still has to sit both. Mechanical and electrical applicants do not take those two tests, so comity is faster in those disciplines.
California does not run a separate engineering firm certificate of authorization program of the kind Texas or Florida run. The control point is different: a business offering engineering must have a California licensee in responsible charge of the work, and naming rules apply to firm names that imply engineering. Check the board's current rule before you sign a subconsultant whose only California link is a name on a letterhead.
| Licence or authority | Type | Extra CA requirement | Buyer note |
|---|---|---|---|
| Civil PE | Practice act | Seismic Principles + Engineering Surveying exams | Required for most building, site and structural calcs |
| Structural Engineer (SE) | Title authority on a civil licence | NCEES 16-hour SE exam | Needed for DSA school and HCAI hospital structural work |
| Mechanical PE | Practice act | None beyond NCEES PE | HVAC, plumbing and fire design on permitted work |
| Electrical PE | Practice act | None beyond NCEES PE | Solar PV and ESS electrical letters |
| Geotechnical (GE) | Title authority on a civil licence | State GE exam | Soils reports for many public projects |
02Where an SE is mandatory: public schools and hospitals
Two state agencies set the strictest structural rules in California, and both push work to licensed structural engineers.
- Division of the State Architect (DSA) reviews K-12 and community college buildings under the Field Act. Structural plans for those buildings are prepared by a structural engineer, and DSA runs its own plan review and inspection regime on top of the local building department.
- Department of Health Care Access and Information (HCAI), the agency formerly called OSHPD, reviews hospitals and skilled nursing facilities under the Alfred E. Alquist Hospital Facilities Seismic Safety Act. Equipment anchorage on these projects is reviewed closely, and many OEMs need a pre-approval for their skids and cabinets.
For buyers this changes three things. First, the pool of eligible engineers is smaller, so expect fewer bids and longer queues. Second, the review cycle is longer than a city permit, so build two to three agency comment rounds into the schedule. Third, the fee is higher. Our benchmark for industrial equipment anchorage is $2,600 per unit nationally; with the California multiplier that is $2,600 x 1.35 = $3,510 per unit, inside the observed $1,500-$4,800 market range.
For a medical equipment OEM shipping ten different skid types into California hospitals, the anchorage calculations alone run 10 x $3,510 = $35,100. Ask whether the engineer will prepare one calculation per product family with a variable table, which can cut the count to three or four packages. Ask also who owns the calculations after the project, because a pre-approved anchorage you own is reusable across sites.
03What a PE or SE seal costs in California: the arithmetic
We apply the house benchmark formulas, then the 1.35x California multiplier, which reflects SE-level review, seismic design categories D through F across most of the state, and thinner competition. These are typical 2025-2026 market ranges; check every figure against a written quote.
| Scope | Base formula or fee | Worked input | California fee |
|---|---|---|---|
| Residential solar PV / ESS letter | $350 per site ($195 at 25+ a month) | 1 site / volume site | $472.50 / $263.25 |
| Residential beam, bearing wall or foundation | $850 | 1 letter | $1,147.50 |
| Commercial MEP tenant improvement | MAX($2,200, sq ft x $0.55) | 12,000 sq ft = $6,600 | $8,910 |
| Small structural package | MAX($3,800, value x 1.2%) | $250,000 = $3,000, floor $3,800 | $5,130 |
| Structural building calcs + seal | MAX($3,800, value x 1.2%) | $1.8M = $21,600 | $29,160 |
| Equipment seismic anchorage | $2,600 per unit | 1 skid | $3,510 |
Two things move these numbers more than the multiplier. Revision rounds: most quotes include one plan-check response, and every extra round is billed hourly. And scope creep from structural to geotechnical: if the building department asks for a soils report, that is a separate engineer and a separate fee. Run your own inputs in the PE stamp and plan review fee calculator.
04Worked example: a two-state warehouse addition
A logistics developer is adding a tilt-up building in the Inland Empire with a structural construction value of $2.4M. Its engineer of record is licensed in Arizona and Nevada only.
- Base structural fee: $2,400,000 x 0.012 = $28,800, which is above the $3,800 floor.
- California multiplier: $28,800 x 1.35 = $38,880.
- One additional state filing for the engineer: $425 ($225 board application plus $200 average firm filing).
- Total benchmark: $38,880 + $425 = $39,305, or about 1.6% of structural value, inside the 0.8%-2.2% observed range.
The $425 is the cheap part. Because the engineer holds a civil licence, California needs the Seismic Principles and Engineering Surveying exams passed before the engineer can seal. That can take months. The practical options are to hire a California civil or SE as engineer of record and keep the Arizona firm as the design team under that engineer's responsible charge, or to start the licence application now for future projects and use a local seal on this one.
Do not accept a proposal where a California engineer seals drawings they did not supervise or independently check. Responsible charge rules in every state, guided by the NCEES Model Law, prohibit that, and calculations should be retained for the period the board requires. Ask the sealing engineer to state in writing that they will run their own checks and keep the file.
05Staffing, CAD outsourcing and contractor rules
California engineering labor prices at the top of the national range. Contract engineers through agencies in the Bay Area, Los Angeles aerospace corridor and San Diego medtech cluster commonly bill toward the upper half of the $72-$135 per hour national band. The formula is the same everywhere: bill rate = base wage x (1 + markup). A mechanical engineer paid $75 an hour at a 52% markup bills $75 x 1.52 = $114 an hour, or about $237,120 a year at 2,080 hours.
Three local points to check before you choose a model:
- Contractor classification. California's ABC test (Labor Code section 2775 onward) applies to many independent contractors. Licensed professionals have certain exemptions that return to the older multi-factor test, but an unlicensed CAD drafter working only for you is a higher-risk case. Ask counsel before converting a long-term freelancer.
- Temp-to-perm fees. A buyout at 20% of a $156,000 annualized base ($75 x 2,080) is $31,200. Negotiate the step-down to zero at 520 hours, not 1,040.
- Offshore drafting. A 3D CAD FTE at $18 an hour is $2,880 a month. Add the 18% US review buffer and the landed cost is $3,398 a month. If the work is qualified research, add the Section 174 foreign amortization drag of about 20.3% of the foreign spend in year one.

06California R&D credit: 15% of the excess, with limits
California offers a research credit under its own rules, separate from the federal IRC section 41 credit. The headline rate is 15% of qualified research expenses above a base amount, plus 24% of basic research payments to universities and qualified organizations. Our benchmark treats the effective yield as about 5.5% of total QREs, because the base amount absorbs much of the spend. The research has to be performed in California.
Two limits matter in 2024-2026. California capped the use of business credits, including R&D, at $5 million per year for tax years 2024 through 2026, with unused credit carried forward. And the state has been changing which calculation methods it allows; check the Franchise Tax Board's current instructions for Form 3523 before your study begins.
Worked example for a San Jose hardware company: W-2 engineering wages $1,600,000, prototype supplies $150,000, US contractors $380,000. QRE = $1,600,000 + $150,000 + ($380,000 x 0.65) = $1,997,000. Federal credit at about 7.9% = $157,763. California at about 5.5% = $109,835. Combined $267,598.
A 25% contingency fee on that is $66,900. A fixed-fee study with 6 business components is $8,500 + (6 x $1,200) = $15,700. The difference is $51,200 a year. Model your own figures in the R&D credit and Section 174 calculator.
07California buyer checklist
- Confirm the sealing engineer's licence type and number on the BPELSG lookup, and that it matches the discipline (civil for structural calcs, SE for DSA or HCAI work).
- If your engineer is licensed elsewhere, ask whether they have passed the Seismic Principles and Engineering Surveying exams. If not, plan a local engineer of record.
- Get the fee as a formula, not a lump sum: base, multiplier, revision rounds, site visits and travel each listed.
- For hospital or school projects, add agency review rounds to the schedule and ask about pre-approved anchorage you can reuse.
- Ask who owns calculations and models after delivery, and how long the engineer keeps the file.
- For contract engineers, cap the markup in writing and set a 520-hour step-down on conversion fees.
- Check offshore work for Section 174 treatment before you compare hourly rates.
- For the R&D credit, confirm the $5M usage cap, the current FTB method rules and that the study separates California-performed research.

Questions buyers ask
Can a PE licensed in another state seal drawings in California?
Not without a California licence. Civil applicants must also pass the California Seismic Principles and Engineering Surveying exams, even with years of licensure elsewhere. Mechanical and electrical applicants do not take those two exams, so their path is shorter.
Does California require a structural engineer (SE) instead of a civil PE?
For most private buildings a California civil PE can seal structural calculations. Public school structural work reviewed by the Division of the State Architect and hospital work reviewed by HCAI is generally prepared by a licensed structural engineer, so check the agency's current requirement for your project type.
How much does a structural PE stamp cost in California?
Our benchmark is MAX($3,800, 1.2% of structural construction value) times a 1.35 California multiplier. A small job therefore starts near $5,130, and a $1.8M structural package lands near $29,160. Revision rounds, site visits and geotechnical work are usually extra.
Does California require an engineering firm certificate of authorization?
California does not run a separate firm certificate of authorization program like Texas or Florida. A business offering engineering must have a California licensee in responsible charge, and firm naming rules apply. Check the BPELSG's current rule before contracting.
What is the California R&D tax credit rate?
California allows 15% of qualified research expenses above a base amount and 24% of basic research payments, for research performed in California. Business credit usage was capped at $5 million per year for tax years 2024 through 2026, with carryforward of the excess.
