Florida (FBPE) Engineering Guide: Threshold Building Special Inspector Rules, HVHZ Miami-Dade Product Approvals and Seal Fees

In Florida the expensive question is not the seal but whether your building is a threshold building: over three stories or 50 feet, or a large assembly occupancy, and the owner must retain a certified special inspector on top of the engineer of record. Our benchmark multiplier is 1.30x, so a $4.2M structural package seals for about $65,520 before the inspector's fee.

01The board, Chapter 471 and the firm certificate

Engineering in Florida is regulated by the Florida Board of Professional Engineers (FBPE) under Florida Statutes Chapter 471. Day-to-day administration, including applications and licence lookups, is handled by the Florida Engineers Management Corporation on the board's behalf. The board's rules sit in Florida Administrative Code Chapter 61G15, which covers seals, signatures and the responsibility rules for each discipline.

Florida has a single PE licence; there is no separate SE licence. The board's responsibility rules set out what a structural engineer of record must deliver and recognize a delegated engineer who designs and seals specialty components such as trusses, precast or curtain wall under the engineer of record's criteria. For buyers this matters because a curtain wall or truss package is a separate sealed submittal, with a separate fee, and the engineer of record must review it.

Firms need their own authorization. Under F.S. 471.023, a corporation, LLC or partnership offering engineering in Florida must hold a certificate of authorization from the board, with a Florida PE responsible for the engineering. An out-of-state firm with a Florida-licensed engineer still needs the firm certificate. Our benchmark for adding Florida to an engineer's and a firm's portfolio is $425 ($225 individual application plus $200 firm filing average); check the board's current fee schedule and processing times.

Seals may be applied digitally under the board's seal rule, provided the electronic signature and verification method meet the rule. Ask your engineer which method they use, because some building departments still want a specific format.

02Threshold buildings and the special inspector

Florida created the threshold building rule after structural collapses during construction. Under F.S. 553.71, a threshold building is any building greater than three stories or 50 feet in height, or an assembly occupancy exceeding 5,000 square feet with an occupant content greater than 500 persons. Check the current statute text for your occupancy, because local enforcing agencies may apply it more broadly.

Three consequences follow, each with a cost:

  1. Threshold inspection plan. The engineer or architect of record prepares a structural inspection plan that is submitted with the permit. It lists what the special inspector must see: reinforcing before each pour, shoring and reshoring, post-tensioning, precast connections, masonry grouting. Ask whether the plan is in the engineer's base fee; often it is a line item.
  2. Special inspector. Under F.S. 553.79 the owner retains a special inspector, a Florida PE certified by the board as a special inspector, or an architect qualified under Chapter 481, to perform the plan's inspections. The inspector reports to the enforcing agency and is paid by the owner, not the contractor.
  3. Shoring design. Shoring and reshoring for threshold buildings are designed by a Florida PE, usually the contractor's specialty engineer.

Special inspector fees are not part of the seal benchmarks on this page. They are quoted per visit or as a monthly retainer for the structural phase, and the number of visits follows the pour schedule. Ask for the visit count assumed, the rate for an unplanned visit, and whether reports are delivered to the building department within the time the enforcing agency expects.

03HVHZ product approvals and condo milestone inspections

The high-velocity hurricane zone (HVHZ) in the Florida Building Code covers Miami-Dade and Broward counties. Inside it, envelope products such as windows, doors, shutters and roofing need an approval that meets the HVHZ test protocols. In Miami-Dade that is commonly a Notice of Acceptance (NOA); elsewhere in Florida a statewide Florida Product Approval is used. A product approved statewide but not for HVHZ use will be rejected in Miami-Dade or Broward.

Engineering effects in the HVHZ: wind loads are higher, rooftop equipment needs anchorage calculations sealed for the zone, and plan reviewers look closely at connection details. That is the main reason for the 1.30x benchmark multiplier. Rooftop equipment anchorage at the $2,600 national base becomes $2,600 x 1.30 = $3,380 per unit.

For existing buildings, the 2022 condominium safety law created milestone inspections under F.S. 553.899. Condominium and cooperative buildings three stories or more must have a structural inspection by a licensed engineer or architect when the building reaches the age set in the statute, with a second, more detailed phase if the first finds substantial deterioration. Associations also need a structural integrity reserve study. The statute has been amended since 2022, so check the current age triggers and deadlines for your county before scoping.

For an association, the procurement point is to bid phase one and phase two separately, and to ask what testing, such as concrete cores or pull tests, is included in phase two.

04Florida seal costs: the arithmetic

We apply the house formulas, then the 1.30x Florida multiplier. These are typical 2025-2026 market ranges; check each against a written quote.

House base fee x 1.30 Florida multiplier
ScopeBase formula or feeWorked inputFlorida fee
Residential solar PV / ESS letter$350 per site ($195 at 25+ a month)1 site / volume site$455 / $253.50
Residential beam or foundation letter$8501 letter$1,105
Commercial MEP tenant improvementMAX($2,200, sq ft x $0.55)10,000 sq ft = $5,500$7,150
4-story office, structuralMAX($3,800, value x 1.2%)$2.0M = $24,000$31,200
12-story condo, structuralMAX($3,800, value x 1.2%)$9.5M = $114,000$148,200
Rooftop equipment anchorage (HVHZ)$2,600 per unit1 unit$3,380

Worked example: a Georgia firm designs a six-story mixed-use building in Fort Lauderdale with $4.2M of structural work. Base: $4,200,000 x 0.012 = $50,400. Florida multiplier: $50,400 x 1.30 = $65,520. Add $425 for the Florida licence and firm certificate: $65,945, about 1.57% of structural value. Add separately: the threshold inspection plan if not included, delegated engineer submittals for trusses or curtain wall, and the owner's special inspector. Run your scope in the PE stamp and plan review fee calculator.

05Staffing and shop drawing outsourcing in Florida

Florida's engineering labor market is split between construction (South Florida, Tampa, Orlando), aerospace and space launch (the Space Coast), and simulation and defense training (Orlando). Construction-side demand for structural and MEP designers rises and falls with the condo and hospitality cycle, so agency markups widen in peak years.

The formula: bill rate = base wage x (1 + markup). A structural designer paid $50 an hour at a 50% markup bills $50 x 1.50 = $75 an hour, or $156,000 a year at 2,080 hours. A 20% buyout on the $104,000 annualized base is $20,800 if you convert early; ask for a 520-hour step-down.

Shop drawings and rebar detailing are the classic outsourcing case. A 2D detailing FTE at $14 an hour is $2,240 a month; with the 18% US review buffer the landed cost is about $2,643 a month. In Florida that review buffer is not optional: the delegated engineer or engineer of record must review shop drawings, and HVHZ connection details draw more plan-review comments than average. Ask the offshore bureau for a Florida Building Code checklist, a named redline turnaround SLA and a rework rate it will commit to in writing.

For aerospace and defense roles on the Space Coast, offshore delivery is commonly ruled out by ITAR, and staffing quotes should be compared on US-person availability as much as rate. Compare models in the staffing vs outsourcing TCO calculator.

06Florida R&D credit: small, capped and application-based

Florida has no personal income tax, and its research incentive is narrow. The corporate income tax credit under F.S. 220.196 is generally 10% of qualified research expenses above a base amount, available to businesses in qualifying target industries, and subject to an annual statewide cap that is allocated among applicants. If applications exceed the cap, every applicant receives a pro rata share. Check the Department of Revenue's current application window and cap, because the allocation is annual.

That makes the federal credit the main event for most Florida engineering firms. Worked example for a Tampa engineering firm: W-2 research wages $900,000, supplies $40,000, US subconsultants $200,000. QRE = $900,000 + $40,000 + ($200,000 x 0.65) = $1,070,000. Federal credit at about 7.9% = $84,530.

For A&E firms the bigger risk is the funded-research rule under IRC section 41(d)(4)(H). Work billed time-and-materials, where the client bears the risk of failure, is commonly disallowed. Before a study, sort projects by contract type and keep only fixed-price work where the firm bore the technical risk.

Fee check: a 25% contingency fee on $84,530 is $21,133. A fixed-fee study with 4 business components is $8,500 + (4 x $1,200) = $13,300, saving $7,833. At this size the gap is modest, which is why scope and defensibility matter more than fee.

07Florida buyer checklist

  • Verify the engineer's licence and the firm's certificate of authorization on the board lookup.
  • Test the building against the threshold definition early; if it qualifies, budget the inspection plan and the special inspector.
  • Retain the special inspector directly as owner, not through the contractor.
  • List delegated engineer submittals (trusses, precast, curtain wall) and who pays for each.
  • In Miami-Dade and Broward, confirm HVHZ approvals for every envelope product before purchase.
  • For condo associations, bid milestone phase one and phase two separately and define phase-two testing.
  • Cap agency markups and set a 520-hour conversion step-down.
  • For R&D credits, screen out time-and-materials projects and check the Florida application window.

Questions buyers ask

What is a threshold building in Florida?

Under F.S. 553.71, a threshold building is greater than three stories or 50 feet in height, or an assembly occupancy over 5,000 square feet with an occupant content over 500 persons. Threshold buildings need a structural inspection plan and an owner-retained special inspector during construction.

Who can be a special inspector for a Florida threshold building?

A Florida PE certified by the board as a special inspector, or an architect qualified under Chapter 481, can serve under F.S. 553.79. The owner retains and pays the inspector, who reports to the enforcing agency.

Does a Florida engineering firm need a certificate of authorization?

Yes. Under F.S. 471.023, a corporation, LLC or partnership offering engineering in Florida must hold a certificate of authorization from the Florida Board of Professional Engineers, even if its engineers are already Florida-licensed.

How much does a structural PE seal cost in Florida?

Our benchmark is MAX($3,800, 1.2% of structural construction value) times a 1.30 Florida multiplier. A $2.0M structural scope lands near $31,200 and a $9.5M high-rise near $148,200, before special inspection and delegated engineer submittals.

Which Florida counties are in the high-velocity hurricane zone?

Miami-Dade and Broward. Envelope products there need HVHZ-level approval, commonly a Miami-Dade Notice of Acceptance, and rooftop equipment needs anchorage calculations sealed for HVHZ wind loads.

Does Florida have a state R&D tax credit?

Yes, but it is narrow. F.S. 220.196 offers a corporate income tax credit of generally 10% of qualified research expenses above a base, for target-industry businesses, under an annual statewide cap allocated among applicants. Most Florida firms get far more from the federal Section 41 credit.
