Virginia, Maryland & New Jersey Corridor: Cleared Defense/Federal Engineering Staffing Markups, Site-Plan PE Seals & COA Rules

In the Virginia, Maryland and New Jersey corridor, the engineering cost driver is US-person and clearance status, not the seal. A cleared systems engineer on an $80/hr base at a 50% markup bills $120/hr, about $249,600 a year, and ITAR and CMMC rules usually rule out the offshore alternative. Civil site plans follow the base house formulas at 1.0x, with firm registration required in Virginia.

01Boards and firm rules across the three states

Each state regulates engineering on its own terms, and a firm working the corridor usually needs all three.

  • Virginia: the Board for Architects, Professional Engineers, Land Surveyors, Certified Interior Designers and Landscape Architects, within the Department of Professional and Occupational Regulation (DPOR). Virginia requires business entities that offer engineering to hold a business entity registration with the board, with a licensed professional in responsible charge.
  • Maryland: the State Board for Professional Engineers, within the Maryland Department of Labor. Confirm the current firm-level requirement with the board before contracting through an entity; do not assume it matches Virginia.
  • New Jersey: the State Board of Professional Engineers and Land Surveyors, within the Division of Consumer Affairs. New Jersey expects business entities offering engineering to hold a Certificate of Authorization. Check the board's current rule for entity types and the named licensee.

All three follow the NCEES Model Law principle of responsible charge and accept NCEES Record holders for comity. None is in the 1.35x SE-mandatory group. A firm licensed in one state and adding the other two budgets 2 x $425 = $850 in house planning cost, plus lead time and renewal cycles that do not line up.

Federal work adds a twist. Projects on federal property may not need local permits, but agency design standards and contract clauses usually still require a licensed engineer's seal. Read the contract's professional services clauses, not just state law.

02Site-plan and facility seals: what they cost

The corridor's civil workload is heavy: data center campuses in Northern Virginia, federal facility upgrades, and logistics and pharmaceutical sites in New Jersey. Stormwater and erosion permitting runs through state environmental programs and local review, which drives schedule more than fee.

For structural and MEP scopes, the base house formulas apply at 1.0x.

Worked example: secure facility renovation

  • MEP plan review and seal for 22,000 sq ft: MAX($2,200, 22,000 x $0.55) = $12,100
  • Structural for a $1.1M hardening scope: MAX($3,800, $1,100,000 x 0.012) = $13,200
  • Generator and fuel tank anchorage, 3 units: 3 x $2,600 = $7,800
  • Total benchmark: $33,100

Civil site plans vary too much by site for one formula. Get scope-based quotes and compare the number of review cycles included. In counties with long queues, a quote that covers three comment responses is worth more than a cheaper one covering one.

Residential beam / foundation$850 flat1 letter$850
Two additional states$425 per stateMD + NJ added$850

Northern Virginia data center campuses show why per-square-foot formulas need judgment. A 250,000 sq ft building computes to 250,000 x $0.55 = $137,500 for MEP review and seal, but owners with repeat prototypes often negotiate a per-building rate after the first site because the design effort falls on later buildings. Ask for a first-building price and a repeat-building price in the same proposal. In New Jersey, pharmaceutical and lab renovations often bundle process utilities with building MEP; ask the engineer to split the two so you can compare each against the benchmark. Run your own figures in the PE stamp fee calculator.

03Cleared and US-person staffing: markup math

Defense and federal programs in the corridor rely on cleared systems, software, RF and hardware engineers. The supply is limited by clearance status, so base wages run high. Agencies still price as bill rate = base wage x (1 + markup), with typical engineering markups of 45% to 62%.

Example: four cleared engineers at an $80/hr base for 12 months (2,080 hours each).

  • At 50% markup: $80 x 1.50 = $120.00/hr; 4 x 2,080 x $120 = $998,400
  • At 58% markup: $80 x 1.58 = $126.40/hr; 4 x 2,080 x $126.40 = $1,051,648
  • Difference: $53,248 a year on four engineers

Check these terms in cleared MSAs:

  • Clearance sponsorship: who pays and who holds the clearance if the engineer converts or leaves.
  • Conversion fee: commonly 20%-25% of salary before 520 to 1,040 hours. On a $166,400 salary, 20% is $33,280.
  • Billable hours on site: secure spaces limit remote work, so define how travel and badge-in time are billed.
  • Flowdowns: the agency must accept DFARS cybersecurity and export clauses that apply to your prime contract.

04Why offshoring rarely works here: ITAR, EAR and CMMC

Most corridor buyers ask whether offshore CAD at $18/hr ($2,880 per FTE-month) can replace part of a $120/hr team. For controlled work, the answer is usually no.

  • ITAR (22 CFR 120-130): sending defense-article technical data to a foreign person, abroad or in the US, is an export that needs authorization. CAD models and drawings of controlled items are technical data.
  • EAR: dual-use technical data can also need a license depending on the item's classification and destination.
  • DFARS 252.204-7012 and NIST SP 800-171: contractors handling controlled unclassified information must protect it to the NIST standard and report incidents.
  • CMMC 2.0: certification requirements are being phased into DoD contracts. Check which level and phase applies to your solicitation.

Offshore and cloud tools are not banned outright for unclassified, uncontrolled work. Split the work by classification. Commercial product lines, facility drafting with no controlled content, and public infrastructure can go to a bureau with ISO 27001 controls and an 18% internal QA buffer. Controlled work stays with US persons in compliant environments.

Example: if 30% of a 10-person design team's hours are uncontrolled, moving 3 FTE offshore costs 3 x $2,880 x 12 x 1.18 = $122,342 a year against 3 x $249,600 = $748,800 cleared agency cost. See the ITAR/EAR CAD and PLM playbook.

05Federal and state R&D credits for corridor contractors

Government contractors face the funded-research question under IRC Section 41(d)(4)(H). Research paid for under cost-reimbursement contracts, where the government bears the risk of failure, is generally excluded. Independent research and development, and fixed-price development where the contractor bears the risk and keeps substantial rights, can qualify. The federal benefit nets about 7.9% of QREs.

Example: $2M of company-funded engineering wages and $250,000 of US subcontract engineering on internal programs.

  • QRE: $2,000,000 + ($250,000 x 0.65) = $2,162,500
  • Federal net: $2,162,500 x 0.079 = $170,838

State layers, each with current rules to check:

  • Virginia offers a refundable Research and Development Expenses Tax Credit, subject to a statewide cap with pro-rata allocation, and a separate credit for larger research spenders.
  • Maryland runs an application-based R&D credit with a statewide cap. Its structure has been revised recently; check the Department of Commerce's current program.
  • New Jersey offers a corporation business tax research credit, and its Technology Business Tax Certificate Transfer Program lets qualifying technology companies sell net operating losses and unused research credits.

Questions buyers ask

What is a typical bill rate for a cleared engineer in Northern Virginia?

Agencies price cleared engineers as base wage times one plus markup, with markups commonly 45% to 62%. An engineer on an $80 per hour base at a 50% markup bills $120 per hour, about $249,600 a year. Clearance level and scarcity push base wages up, so negotiate the markup separately from the wage.

Can we send defense CAD work to an offshore bureau?

Not for ITAR-controlled technical data without export authorization, because releasing it to a foreign person is an export under 22 CFR 120-130. Uncontrolled commercial or facility work can often go offshore, so classify each work package before sourcing it.

Does Virginia require engineering firms to register?

Yes. Virginia requires business entities offering engineering to hold a business entity registration with the DPOR board that covers professional engineers, with a licensed professional in responsible charge. An individual PE license does not cover the company.

Do government contracts qualify for the R&D tax credit?

Research paid for under cost-reimbursement contracts, where the government bears the risk, is generally excluded as funded research under IRC Section 41(d)(4)(H). Internally funded research and fixed-price development where the contractor bears the risk and keeps substantial rights can qualify.

Can New Jersey tech companies sell R&D credits?

Yes. New Jersey's Technology Business Tax Certificate Transfer Program lets qualifying technology and life-science companies sell net operating losses and unused research credits for cash. Eligibility and annual allocations are set by the program, so check the current terms.
